An Affinity Behavioral Health psychiatrist accused of having inappropriate sexual contact with a patient could spend time in prison if convicted of felony charges.
Charles D. Morgan, 62, of Neenah, was charged in Winnebago County Circuit Court Monday with sexual exploitation by a therapist, a felony that carries a maximum penalty of 12 years, six months in prison and $25,000 in fines.
According to the criminal complaint, Morgan sexually assaulted a 27-year-old woman, whom he had been treating for bi-polar disorder for the past two years. The woman told Morgan she wanted a different psychiatrist after he kissed her on two occasions while she was in the hospital receiving treatment.

A judge has denied a request by a Clifton child psychiatrist to keep his license while he appeals its revocation by the State Medical Board of Ohio.
The board permanently revoked the license of Leo D’Souza, 66, after concluding he had sexual contact with patients, failed to conform to minimal standards of care and violated principles of medical ethics.

A Melbourne psychiatrist twice banned for making sexual advances on female patients is fighting to regain his medical registration.
Alfred Harold Leitmanis was struck off the medical register in January 2004 after he allegedly told a patient he dreamed of having sex with her and took her to his house where he tried to kiss her.
Dr Leitmanis had told the woman’s GP he believed she suffered from low self-esteem and sought approval through sexual relationships after she was referred to him in April 2002.

A SOUTHALL psychiatrist who groped a nurse and then kissed a policeman’s boot to beg forgiveness has been struck off for lying to get work.
Dr Idowu Otote, 43, of Rutland Road, was banned for 12 months in 2006 for failing to keep his skills up to scratch.
He then claimed in application forms to Gwent and Maudsley NHS trusts that he would be free to practice again by November 17, 2006.
Dr Otote admitted making two inaccurate job applications, but denied dishonesty on the basis it was all a misunderstanding.
He told the GMC he had sent the applications using a draft model answer to the questions, but forgot to check it before he sent them, but he could not explain why there were still “significant differences” between the two.
Panel Chair Howard Freeman said the GMC had “serious concerns” about the way Dr Otote deliberately misled the two health trusts, and found his fitness to practise was impaired.

PRLog (Press Release) – May 19, 2008 – According to Court documents filed in late February, psychiatrist Richard Golden has been ordered to pay more than 150,000 dollars in compensation which is to be shared with two of the three teenage girls who the doctor sexually assaulted during the years from 2000 to 2005.
A fourth complaint of indecent behavior was filed In August last year with the College of Physicians and Surgeons against Dr. Golden. The complaint was also filed with the Citizens Commission on Human Rights (CCHR), a social reform group that investigates and exposes psychiatric violations of human rights. The complaint alleged among other things that Dr. Golden would hug his 18 year old woman patient on many occasions during which time he would have an erection.

Crossville Chronicle
A Cookeville psychiatrist who had an office in Crossville has been indicted by the Cumberland County Grand Jury on two counts of statutory rape by an authority figure, according to the Cumberland County Sheriff’s Department.
Dr. Chip Hayward Fountain, 44, was indicted by the grand jury on May 6 after “a thorough investigation” by the Department of Children’s Services, District Attorney General’s Office and the sheriff’s department. Fountain surrendered to authorities at the Justice Center on May 27.
A press release states that Fountain, who in addition to Cookeville and Crossville, had an office in Livingston, is accused of “being sexually involved with a former juvenile female patient.”
Bond was set at $15,000 and Fountain is scheduled to appear for arraignment in Cumberland County Criminal Court on June 2, according to Investigator Jeff Slayton’s release.
Fountain graduated from Texas Tech University Health Service Center School for Medicine in the late 1990s.

The upcoming trial of Dr. William Ayres, the prominent San Mateo child psychiatrist facing allegations he molested seven pre-adolescent patients, has once again been postponed.
The jury trial, which was scheduled for June 23, won’t take place until at least the end of July, San Mateo County prosecutors said Friday.
The ongoing drama behind the delay revolves around a defense motion to suppress all evidence acquired by search warrants that gave investigators access to Ayres’ patient files. A Superior Court judge heard arguments Friday on the motion from both the prosecution and the defense, but he postponed a final decision until July 23, Chief Deputy District Attorney Steve Wagstaffe said.

Four young patients said he sexually molested them
A Cincinnati child psychiatrist who is facing sex crime charges lost his medical license this week.
The Ohio Medical Board permanently revoked the license of Leo D’Souza after reviewing a 50-page report on the accusations that several former patients made against him.
A Hamilton County grand jury indicted D’Souza in February on four charges of gross sexual imposition and one charge of sexual imposition. The charges involve four patients, now ages 14 to 21, who accuse the doctor of molesting them.
The indictment does not name D’Souza’s accusers, so it is unclear whether the medical board considered the same accusations as the grand jury.
A hearing examiner for the board found there was “no acceptable reason” for D’Souza to have examined the genitalia of male patients in his office. D’Souza told the examiner he conducted only a visual examination, while the patients said he touched them and did not use gloves.

UTICA, N.Y. — The state health commissioner has pulled the license of a Utica psychiatrist.
Anthony Nappi, 80, has been charged with 46 incidents of medical misconduct with 11 different patients. The list of charges are extensive and the Department of Health says Dr. Nappi inappropriately touched female patients, made inappropriate remarks, failed to perform patient assessments or order laboratory tests and breached patient confidentiality.
A hearing on the charges is set for next week. Until then, his license is suspended, meaning he cannot care for patients.

IOWA CITY – An Iowa City psychologist who was arrested on child porn charges will not be seeing any patients for a while.
On Wednesday, the Iowa Board of Psychology approved a stipulated order that restricts Howard Weinberg, Ph.D. from practicing psychology.
Back on April 16th, police arrested Weinberg for allegedly having child pornography on his computer. Weinberg is officially charged with possession of images depicting the exploitation of a minor.
The stipulated order states that if Weinberg continues to practice psychology the board can revoke or suspend Weinberg’s license. The board says it will continue to investigate the matter until the criminal charge is resolved.
Police confiscated five computers from Weinberg’s home. They say they found hundreds of images and dozens of videos of child pornography on at least one of those computers. According to police many of the children appear to be 10 years old or younger and many look like they are under five.
Weinberg is a clinical psychologist in Iowa City. He has worked with couples and families, including children.
Iowa City Police Sergeant Troy Kelsay said, “Right now there is no evidence that he was making these images himself. That’s a possibility, we just don’t know yet.”
Police say there is a very real possibility more charges will be filed.
They found out about the images from a computer store working on Weinberg’s computer. An employee saw the images and called police. Police say the staff at Neo Computers is taking some heat for turning in Weinberg. Some people apparently do not like the idea that a company searching your computer can find illegal activity and report it to the cops. But police say the company did the right thing. They stress there is no right to privacy. If you take your computer in to be serviced by anyone, and that person finds evidence of criminal activity he or she should call the police.
Weinberg has been a licensed psychologist in Iowa since 1989. The State Department of Public Health regulates licenses for psychologists. The board can make an emergency decision to suspend or repeal a license if the members believe there is a risk of immediate danger to the public.
The Bureau of Professional Licensure is a Bureau within the Iowa Department of Public Health with 19 licensure boards regulating 39 professions. The mission of the professional boards is to protect the public health, safety and welfare by licensing qualified individuals and enforcing Iowa’s statutes and administrative rules fairly and consistently.
